    	abstract = {Law No. 1 of 2023 on the New Penal Code introduces community service as a principal punishment, reflecting a shift from a retributive toward a more humane and rehabilitative sentencing paradigm, yet the effectiveness of its application remains uncertain due to inadequate technical regulation and institutional readiness. This study aims to analyze the regulation and implementation of community service as a principal punishment under the New Penal Code and juridical aspects affecting the effectiveness of its application. The study employs a normative legal method with conceptual and statutory approaches, examining legal materials through library research from an ius constituendum perspective. The findings show that community service is positioned as an alternative to short-term imprisonment in line with the Tokyo Rules, with parameters including the offender's admission of guilt, capacity to perform the work, limits on working hours, and a prohibition on commercialization, yet its implementation remains hindered by the limited readiness of the Correctional Center (Balai Pemasyarakatan) and Community Supervisors (Pembimbing Kemasyarakatan). The study concludes that the success of community service depends on strengthening technical regulation, institutional capacity, and coordination among law enforcement agencies so that the goals of rehabilitation and social reintegration can be effectively achieved. ABSTRAKUndang-Undang Nomor 1 Tahun 2023 tentang KUHP Baru memperkenalkan pidana kerja sosial sebagai pidana pokok yang mencerminkan pergeseran paradigma pemidanaan dari pembalasan menuju pendekatan humanis dan rehabilitatif, namun efektivitas penerapannya masih dipertanyakan karena kesiapan regulasi teknis dan kelembagaan yang belum memadai. Penelitian ini bertujuan menganalisis pengaturan dan implementasi pidana kerja sosial sebagai pidana pokok dalam perspektif KUHP Baru serta aspek yuridis yang memengaruhi efektivitas penerapannya. Penelitian menggunakan metode hukum normatif dengan pendekatan konseptual dan perundang-undangan, menelaah bahan hukum melalui studi kepustakaan dari perspektif ius constituendum. Hasil penelitian menunjukkan pidana kerja sosial diposisikan sebagai alternatif pidana penjara jangka pendek sejalan dengan Tokyo Rules, dengan parameter berupa pengakuan pelaku, kemampuan melaksanakan pekerjaan sosial, batasan jam kerja, dan larangan komersialisasi, namun implementasinya masih terhambat oleh keterbatasan kesiapan Balai Pemasyarakatan dan Pembimbing Kemasyarakatan. Penelitian menyimpulkan bahwa keberhasilan pidana kerja sosial bergantung pada penguatan regulasi teknis, kelembagaan, dan koordinasi antar aparat penegak hukum agar tujuan rehabilitasi dan reintegrasi sosial dapat terwujud secara efektif.},
