    	abstract = {The criminal law reform under Law No. 1 of 2023 on the Penal Code introduces community service as an alternative principal punishment besides imprisonment, yet its regulation remains general, creating ambiguity in its practical implementation mechanism. This study aims to analyze the application of community service punishment under Law No. 1 of 2023 on the Penal Code and its standing as an alternative sentencing option within Indonesia's criminal justice system. The study employs a normative juridical method through library research on primary and secondary legal materials, analyzed by examining the relevant legal principles, doctrines, and sentencing concepts. The findings show that community service is regulated under Article 85 and Article 82 paragraph (2) letter c of the National Penal Code, with a duration of 8-240 hours, performed without remuneration and prohibited from commercialization, yet its implementation remains hindered by the absence of implementing regulations on the type of work, procedures, and supervision. The study concludes that comprehensive technical regulation, institutional readiness, and synergy among law enforcement agencies are needed so that community service can be applied consistently and achieve restorative justice. ABSTRAKPembaruan hukum pidana melalui Undang-Undang Nomor 1 Tahun 2023 tentang KUHP memperkenalkan pidana kerja sosial sebagai alternatif pidana pokok selain pidana penjara, namun pengaturannya masih bersifat umum sehingga menimbulkan ketidakjelasan mekanisme penerapan dalam praktik. Penelitian ini bertujuan menganalisis penerapan pidana kerja sosial berdasarkan Undang-Undang Nomor 1 Tahun 2023 tentang KUHP serta kedudukannya sebagai alternatif pemidanaan dalam sistem hukum pidana Indonesia. Penelitian menggunakan metode yuridis normatif melalui studi kepustakaan atas bahan hukum primer dan sekunder, dianalisis dengan menelaah asas hukum, doktrin, dan konsep pemidanaan yang relevan. Hasil penelitian menunjukkan pidana kerja sosial diatur dalam Pasal 85 dan Pasal 82 ayat (2) huruf c KUHP Nasional dengan durasi 8-240 jam tanpa imbalan dan larangan komersialisasi, namun implementasinya masih terhambat karena belum tersedia peraturan pelaksana teknis mengenai jenis pekerjaan, tata cara, serta pengawasannya. Penelitian menyimpulkan bahwa diperlukan regulasi teknis yang komprehensif, kesiapan kelembagaan, dan sinergi antar aparat penegak hukum agar pidana kerja sosial dapat diterapkan secara konsisten dan mewujudkan keadilan restoratif.},
