    	abstract = {The development of artificial intelligence technology has given rise to behavioral disturbances that may affect an offender's capacity for criminal responsibility, yet the New Penal Code lacks explicit juridical parameters on whether such disturbances can be qualified as an excuse (alasan pemaaf). This study aims to juridically analyze the application of the excuse defense to offenders of crimes based on artificial-intelligence-related disturbance under the New Penal Code. The study employs a normative legal method with statutory and conceptual approaches, analyzing primary and secondary legal materials qualitatively through library research. The findings show that artificial intelligence remains positioned as a means rather than a legal subject that can be held criminally liable, so its use does not automatically negate the offender's fault; the excuse defense can only be applied where it is objectively proven, through medical and psychiatric examination and expert testimony, that the disturbance eliminated the offender's capacity to understand the unlawfulness of the act or to control their will. The study concludes that applying the excuse defense to claims of artificial-intelligence-related disturbance must be carried out restrictively and based on objective evidence in order to preserve legal certainty, justice, and legal expediency. ABSTRAKPerkembangan teknologi kecerdasan buatan memunculkan gangguan perilaku yang berpotensi memengaruhi kemampuan bertanggung jawab pelaku tindak pidana, namun KUHP Baru belum memiliki parameter yuridis eksplisit mengenai apakah gangguan tersebut dapat dikualifikasikan sebagai alasan pemaaf. Penelitian ini bertujuan menganalisis secara yuridis penerapan alasan pemaaf terhadap pelaku tindak pidana berbasis gangguan kecerdasan buatan menurut KUHP Baru. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, menganalisis bahan hukum primer dan sekunder secara kualitatif melalui studi kepustakaan. Hasil penelitian menunjukkan kecerdasan buatan tetap diposisikan sebagai sarana, bukan subjek hukum yang dapat dimintai pertanggungjawaban pidana, sehingga penggunaannya tidak otomatis menghapus kesalahan pelaku; alasan pemaaf hanya dapat diterapkan apabila terbukti secara objektif melalui pemeriksaan medis, psikiatris, dan keterangan ahli bahwa gangguan tersebut menghilangkan kemampuan memahami sifat melawan hukum atau mengendalikan kehendak pelaku. Penelitian menyimpulkan bahwa penerapan alasan pemaaf terhadap klaim gangguan berbasis kecerdasan buatan harus dilaksanakan secara restriktif dan berbasis pembuktian objektif agar tetap menjaga kepastian hukum, keadilan, dan kemanfaatan hukum.},
