KONSTRUKSI HUKUM KETERWAKILAN PEREMPUAN DALAM PEMILU: KAJIAN TERHADAP KARAKTER LEX IMPERFECTA DAN REGULATORY GAP DALAM SISTEM PEMILU INDONESIA

Abstract


Women’s representation in Indonesia’s electoral legal system has been recognized through a minimum quota of 30 percent for legislative candidates. However, the effectiveness of this provision is not determined solely by the existence of the norm, but also by how that norm is enforced in practice. Existing regulations, whether in Law No. 7 of 2017 or the KPU’s technical regulations, place greater emphasis on compliance with administrative procedures rather than on the consequences of noncompliance. As a result, this obligation tends to function as a flexible formal requirement. This situation reflects the nature of lex imperfecta—that is, norms that are not accompanied by strict sanctions—thereby creating a regulatory gap and weakening law enforcement. This phenomenon was evident in the 2024 General Election in Gorontalo Electoral District 6, where the provisions on women’s representation were not fully complied with but were nonetheless accepted in the electoral process. This study employs a normative legal method using a statutory approach and a case-based approach through an analysis of Constitutional Court Decision No. 125-01-08-29/PHPU.DPR-DPRD-XXII/2024. The novelty of this study lies in the analysis of women’s representation not only as an affirmative action policy but as an issue concerning the nature of legal norms, examined through the concepts of lex imperfecta and regulatory gaps in the Indonesian electoral system. In addition, this study specifically examines the implications of the absence of sanctions for the authority and law enforcement practices of the General Elections Commission (KPU) following the Constitutional Court’s ruling. The results of the study indicate that the weakness of sanction mechanisms has caused the provisions on women’s representation to lose their enforceability and to rely more on political compliance by parties than on the effectiveness of the legal norms themselves.

 

ABSTRAK

Keterwakilan perempuan dalam sistem hukum pemilu Indonesia telah diakui melalui ketentuan kuota minimal 30 persen dalam pencalonan anggota legislatif. Namun, efektivitas ketentuan tersebut tidak hanya ditentukan oleh keberadaan norma, melainkan juga oleh bagaimana norma tersebut ditegakkan dalam praktik. Pengaturan yang ada, baik dalam Undang-Undang Nomor 7 Tahun 2017 maupun regulasi teknis KPU, lebih menekankan pada pemenuhan prosedur administratif dibandingkan dengan konsekuensi atas ketidakpatuhan. Akibatnya, kewajiban tersebut cenderung berfungsi sebagai persyaratan formal yang fleksibel. Kondisi ini menunjukkan karakter lex imperfecta, yaitu norma yang tidak disertai sanksi yang tegas, sehingga menimbulkan regulatory gap dan memperlemah penegakan hukum. Fenomena ini tampak dalam Pemilu 2024 di Dapil Gorontalo 6, di mana ketentuan keterwakilan perempuan tidak sepenuhnya dipatuhi namun tetap diterima dalam proses pemilu. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus melalui analisis Putusan Mahkamah Konstitusi Nomor 125-01-08-29/PHPU.DPR-DPRD-XXII/2024. Kebaruan (novelty) penelitian ini terletak pada analisis keterwakilan perempuan tidak hanya sebagai kebijakan afirmatif, tetapi sebagai persoalan karakter norma hukum yang dikaji melalui konsep lex imperfecta dan regulatory gap dalam sistem pemilu Indonesia. Selain itu, penelitian ini juga mengkaji secara spesifik implikasi kekosongan norma sanksi terhadap kewenangan dan praktik penegakan hukum oleh KPU pasca putusan Mahkamah Konstitusi. Hasil penelitian menunjukkan bahwa lemahnya mekanisme sanksi menyebabkan ketentuan keterwakilan perempuan kehilangan daya paksa dan lebih bergantung pada kepatuhan politik partai dibandingkan efektivitas norma hukum itu sendiri.
